OLIVE TREE REWARDS PROGRAM MEMBER AGREEMENT TERMS AND CONDITIONS

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ENROLLING OR OTHERWISE PARTICIPATING IN THIS PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE.

I AUTHORIZE OLIVE TREE BIBLE SOFTWARE AND ITS PARENT AND AFFILIATES (“OLIVE TREE”) TO EXCHANGE INFORMATION ABOUT MY ACCOUNT AND MYSELF SO THAT I CAN RECEIVE THE BENEFITS OF THE OLIVE TREE REWARDS PROGRAM, AND SO THAT OLIVE TREE CAN INFORM ME OF ADDITIONAL INFORMATION, OFFERS AND OPPORTUNITIES.

General. This Member Agreement includes terms and conditions and other details about the relationship between you and Olive Tree relating to the Olive Tree Rewards Program (the “Program”). By enrolling in or otherwise participating in, the Program, you acknowledge that you have read and understood this Member Agreement and that you agree to be bound by it, as well as all additional policies, terms and conditions referenced and incorporated into this Member Agreement, all of which may be amended from time to time (“Terms”). Olive Tree reserves the right to change, modify and/or eliminate the Program and/or these Terms or any policy, FAQ, or guideline pertaining to the Program at any time and at its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to www.OliveTree.com/rewards/terms.php , and you waive any right you may have to receive specific notice of such changes or modifications. If you do not agree to all of the Terms now or at any point in the future, please contact Olive Tree Customer Service at 509-466-5700 Monday – Friday between the hours of 8 am – 4 pm PST or email support@olivetree.com to un-enroll. These Terms constitute a legally binding agreement between Olive Tree and each individual who enrolls orparticipates in the Program. These Terms are separate from, and not affiliated with, and do not alter in any way the terms or conditions of any other agreement you may have with Olive Tree for products, services or otherwise.

Membership. Participating in the Program and the benefits of the Program are offered at the sole discretion of Olive Tree. Eligible customers (as described below) may enroll or otherwise participate. One (1) Program membership per customer. Your membership is nontransferable and is subject to these and future Program Terms. All information collected by you in connection with the Program is subject to our privacy policy, which can be found at https://www.olivetree.com/press/privacy.php. Please read our Privacy Policy carefully to understand how Olive Tree collects, uses and discloses information about customers and how to update or change your personal information and how we communicate with you. Purchases made on OliveTree.com are subject to the Terms of Use posted on the site. In the event that the site’s Terms of Use conflict with these Program Terms, the Program Terms will control.

Eligibility. The Program is open to individual U.S. residents (excluding Guam, Puerto Rico, U.S. Virgin Islands and territories) at least 13 years of age who provide and maintain a valid email address. If you are between the ages of 13 and the age of majority, you must have permission from your parent or legal guardian and may only enroll or otherwise participate in the Program under the supervision of a parent or legal guardian who agrees to be bound by these Terms, and furthermore, you expressly acknowledge that you may not be eligible for all Program benefits. You may un-enroll at any time by contacting Olive Tree Customer Service at 509-466-5700 Monday – Friday between the hours of 8 am – 4 pm PST or email support@olivetree.com. Your membership is only valid at OliveTree.com.

Program Description. The Program is one way in which Olive Tree endeavors to reward and thank loyal customers for patronizing our business, and purchasing on www.OliveTree.com. Members of the Program are able to earn and accumulate “Points” that may be converted into rewards dollars (“Rewards Dollars”) that may be redeemed for a discount off of future purchases at www.OliveTree.com.

How to Enroll. To enroll in the Program and begin accumulating Points visit www.OliveTree.com/rewards. Follow the prompts to log into your Olive Tree account or to create an account if you do not already have one.

The enrollment process may require that you provide the following information: username, password, email address (required in order to receive all eligible Rewards Dollars), birthday, name, and marketing preferences. All of your Points can be activated and registered for use in the Program, but you may only have one (1) account that is personal to you.

Points and Rewards Dollars. The Rewards Dollars that are available to you through the Program are based on the number of “Points” that you earn. You can earn Points by making qualifying purchases using your registered Olive Tree account associated with your Program enrollment at www.OliveTree.com. You will not earn Points by making in-app purchases through any Olive Tree or other third party apps on mobile devices, tablets or otherwise.

You will receive ten (10) Points for each $1 you spend on qualifying purchases made on www.OliveTree.com, except during limited time promotions when Olive Tree may offer “Bonus Points” on featured products or services at its sole discretion. Qualifying purchases for which points will be earned include sale and regularly priced items purchased on www.OliveTree.com. Points are earned on the dollar amount of qualifying purchases after all applicable discounts, offers, coupons and Rewards Dollars are applied and before tax is imposed and shipping costs are added. The purchase of gift cards and group orders are non-qualifying and other exclusions may apply. Certain limitations may apply to Points. For example, there may be a limit on the number of Points that you can earn on a daily basis, and certain Points may have expiration dates. Check the product pages(s) and/or promotional materials for specific restrictions. All Points and actions utilizing Points, including but not limited to earning, saving and using, must be in compliance with this Agreement. Points cannot be earned after the Program and/or your membership is terminated. Unless prohibited by law, unused Points are forfeited upon termination of the Program and/or your membership in the Program is terminated. The amount of Points awarded for qualifying purchases will be the dollar amount rounded up to the nearest one hundred (ex. $5.75 = 60 points).

Points will post to your Program account approximately 24 hours following purchase date, subject to processing timeframes and/or website maintenance. If an item is returned, Points will be deducted from your Program account equal to the amount of Points earned for that applicable amount of that purchase. There are no membership fees associated with the Program. Points accumulated under the Program are promotional and have no cash value and cannot be purchased, sold or redeemed for cash. If you have provided Olive Tree with a current, valid email address, you may receive transactional emails providing a summary of Points earned as well as other promotional content related to the Program. Members may unsubscribe from promotional emails at any time via the unsubscribe link in those emails; provided, however, if you unsubscribe from Olive Tree emails, you may no longer receive those Program benefits that are distributed by email. You can also view and track your available Points on https://www.OliveTree.com/store/orders.php .

For every 500 Points you earn in the Program, you will be eligible to receive $5 in Rewards Dollars. You may redeem Rewards Dollars at checkout if the value of that purchase is equal to or greater than the minimum increment of Rewards Dollars you have accumulated which are then-currently redeemable pursuant to these Terms. We reserve the right to change the amount of Points required to earn Rewards Dollars or otherwise modify these Terms at any time. Points will be converted and Rewards Dollars redeemed on a first-in-first out basis, such that the first Points earned will be the first Points converted and redeemed as Rewards Dollars. Once Points are converted to Rewards Dollars, your Points balance will be reduced by the number of Points used to obtain the Rewards Dollars. In the event of a return, refund or credit adjustment results in insufficient Points for the Rewards Dollars for which the Points were converted, the order may not be fulfilled or may be cancelled. If the Rewards Dollars order is fulfilled and we later discover that you did not have sufficient Points for the Rewards Dollars in your Points balance, in addition to any other actions we may take, this may result in a negative Points balance and future earnings will be applied to the negative balance until it is positive again. You will not be able to redeem Rewards Dollars again until you have a positive balance. Rewards Dollars have no cash value and may not be applied to taxes. Rewards Dollars will not be honored retroactively in connection with any prior purchases.

Your Points and your account under the Program are personal to you and may not be sold, transferred or assigned to, or shared with family, friends or others. You may have only one (1) Program account.

Olive Tree reserves the right to make adjustments and/or terminate your account and/or your participation in the Program if Olive Tree determines in its sole discretion that you have violated these Terms, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, abusive, fraudulent or otherwise unlawful. Olive Tree may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative.

Members who have no qualifying point activity during any contiguous three (3) year period, may have their membership automatically expire on the last day of the third year of membership inactivity and that membership will be inactivated and their Points will expire on that date. Inactive is defined as no Points earned.

Resellers are expressly excluded from the Program.

Olive Tree employees are not eligible to enroll or otherwise participate in the Program.

Olive Tree reserves the right to terminate, discontinue, modify or cancel the Olive Tree Rewards program at any time and in its sole discretion without notice to you.

Olive Tree reserves the right to modify, suspend and/or terminate the Program, without notice, in whole or in part, in the event of computer, programming, system errors or other problems which are beyond Olive Tree's control and that affect Olive Tree's ability to proceed as intended. Any attempts by you to access the Program via a bot script or other brute-force attack shall result in your becoming ineligible and forfeiting any and all accrued Points. Any use of automated means, whether programmatic or robotic or the like, to gather Points shall result in your disqualification from the Program and forfeiture of Points.

You agree to defend, indemnify and hold harmless OliveTree.com and its affiliates, representatives, officers, directors and employees from all liabilities, claims, costs and expenses, including attorney fees that arise out of or in connection with your use of the site or participation in the Program. Olive Tree is not responsible for the inability of a Program member to accept, redeem and/or use Rewards Dollars for any reason, including any third-party's terms and conditions and/or the terms of business and operations for a particular entity (e.g., timeframes for selecting merchandise, registration obligations, etc.) who is offering Rewards Dollars. Normal Internet access and usage charges imposed by a Program member’s online service shall apply.

The validity, interpretation and performance of this Agreement will be controlled by and construed under the laws of the State of New York, without regard to its principles of conflicts of laws and the parties hereby submit to the exclusive jurisdiction of the federal and state courts located in the State and County of New York.
